In a democratic rule-of-law system, allocation decisions about valuable resources cannot be defended merely by saying "my AI said so"; power must be publicly challengeable and reasons must be given. The measure therefore marks a shift toward explainable governance rather than purely technical output, echoing the political theories of Jürgen Habermas and John Rawls that citizens owe each other explanation and reason-giving in public life.

xAI's complaint also attacks the provision excluding diversity-enhancing or historical-redress measures from the definition of algorithmic discrimination. The article notes this is questionable because existing anti-discrimination law already addresses whether affirmative-action type measures are permissible. While the lawsuit itself is an effort at justification, the harder issue is whether models such as Grok can ever fully justify their own allocation outputs.
