检方称三名被告(Ho、Chen、Li)已被羁押,Raymond 获得保释;部分讯息记录显示 Li 自称其父也曾替中共从事类似业务,并明知 A100/H100 等芯片受出口禁令约束而仍参与交易。被告可能面临最高 20 年刑期。法官指出 Li 拥有加州房产等资产,不符合作为公设辩护对象的条件,并将举行听证以判断其是否具潜逃风险,因其持有美国绿卡并拥有香港公民身份。

Nvidia 表示即便是旧型号在二级市场的微小销售也需严格审查,称以走私产品拼装数据中心无论技术或经济上皆不可行。涉案的 AI 云公司 Corvex 撤回对 Raymond 的录用。美国商务部先前曾考虑进一步限制对马来西亚与泰国的先进芯片出口,以压缩走私渠道,目前相关规定尚未最终定案。

US prosecutors charged four individuals in Florida, Alabama, and California with conspiring to smuggle advanced hardware to China, including roughly 400 Nvidia A100 GPUs, about 50 H200s, and around 10 Hewlett Packard Enterprise supercomputers containing H100 chips, receiving nearly $3.9 million from two Chinese firms. The operation used a sham real estate company and routed shipments through Thailand and Malaysia—both identified by US regulators as chip-smuggling hotspots—circumventing export controls aimed at slowing China’s progress in military, surveillance, and autonomous-weapons AI.

Three defendants (Ho, Chen, Li) are in custody while Raymond was released on bond. Prosecutors cite messages in which Li boasted his father had engaged in similar CCP-linked activities and shared articles acknowledging the chips’ export restrictions. Li faces a detention hearing due to potential flight risk, holding both a US green card and Hong Kong citizenship; the judge noted his California home equity disqualifies him from public-defense eligibility.

Nvidia stated that even small secondary-market sales undergo strict review and that assembling datacenters from smuggled components is neither technically nor economically viable. Corvex revoked an employment offer to Raymond. The Commerce Department has considered restricting advanced-chip exports to Malaysia and Thailand to curb smuggling, though such rules remain unfinished.
