Taiwan is considering implementing stricter export controls on advanced AI chips to all customers in China to align with US measures first introduced in 2022. Currently, Taiwan does not criminalize unauthorized AI chip exports to China, making prosecutions difficult. However, last month, authorities made their first detentions of three alleged smugglers on charges of document falsification. If implemented, these new restrictions would allow Taiwan to prosecute AI chip smuggling as a criminal offense for the first time, reinforcing technological and national security.

The potential restrictions immediately impacted the market, with shares of Gigabyte Technology Co. falling up to 3.8% and Asustek Computer Inc. declining by 6.2% on Wednesday. These shifts highlight the delicate balance for Taiwan, which is home to the vast majority of global AI chip manufacturing and has risen to become the world’s fifth-largest (5th-largest) stock market. Additionally, Lai Ching-te's administration has intensified domestic enforcement, including sentencing a former Tokyo Electron Ltd. engineer to a 10-year (10-year) prison term in April for stealing TSMC trade secrets.

Regionally, other US allies face similar pressures to curb chip diversion to China. While Malaysia agreed to match US curbs in 2025, the implementation remains uncertain. Singapore has chosen to address the issue using existing laws, currently prosecuting individuals for defrauding suppliers regarding hardware initially sent to Malaysia. Analysts note that incorporating export control commitments into international trade agreements is increasingly driving domestic policy changes across these key technology hubs.
